Can I Claim Solicitor Negligence Compensation?

Solicitor negligence compensation can be claimed if you feel your legal advisor has handled your case badly, provided bad advice or poor service or you feel you have been overcharged.

There are various circumstances in which a solicitor can be said to be negligent or in breech of the rules of professional conduct.

Poor Service

If your solicitor has provided a poor service than you may be able to claim compensation from the Legal Complaints Service.

Examples of poor service from a solicitor can include:

• Ignored or not carried out the instructions you gave them

• Delayed or not acted on your case for an unreasonable amount of time

• Provided inaccurate information

• Has not kept you fully informed about the progress of your case

• Has not responded to your phone calls or letters

• Not providing a written summary of your likely costs prior to commencement of the case

Solicitor Negligence

A solicitor is said to be negligent if that solicitor has represented a client in a manner in which solicitors would normally act in the same circumstances or has failed to exercise reasonable care in representing the clients interests.

These kind of cases are normally handled by the courts, or in some cases by the solicitors insurers, rather than by the Legal Complaints Service.

There are time limits for making a claim against solicitors so, if you believe you are entitled to claim compensation, than you should contact a different lawyer immediately to discuss your case.

Professional Misconduct

Like most professionals solicitors must comply with the rules of their profession. If the solicitor does not comply with those rules than there may be a case of professional misconduct.

Examples of a solicitors professional misconduct could include:

• Failing to hand over money that belongs to the client

• Being unable to account for money owed to a client

• Representing a client with a conflict of interest with another client

• Discriminatory behaviour on grounds of race, religion, sex, age, disability or age

• Failing to supervise staff conduct
