How to Claim Pedestrian Accident Compensation

    Published on: 28/02/2014

For at least the last five years the Department for Transport’s statistics regarding road accidents to pedestrians in the United Kingdom have remained stubbornly at around the level of 30,000 accidents annually. This is of course 30,000 more accidents a year than anybody would want to see on our roads. Some would argue that such an unacceptable total is an unavoidable fact of life for a country that has, in certain regions, some of the most congested roads in the world and a high pressure life style that sees motor vehicle travel as frustrating, enforced downtime from existence lived at dizzying speed and intensity. However nothing excuses driving which results in injury to pedestrians. As the most unprotected of all road users they have the right to be given way to by motor vehicles, most of which have a far greater number of safety features to protect the driver than they do to reduce injury done to any pedestrian that they might impact with.

If you, as a pedestrian, sustained an injury that was the result of being hit by a motor vehicle, when you had taken all reasonable care to avoid being hit, then you might be able to make a pedestrian accident claim. The strength of any such claim increases dramatically if you were on a pavement or pedestrian crossing when the motor vehicle struck you. You might also be able to make a pedestrian accident claim if your injury was sustained as a result of attempting to avoid being hit by a motor vehicle, for example, hurling yourself into a roadside ditch to avoid being run over. Most claims in this category can be made against the driver’s insurance, but in the event of your being injured by a vehicle driven by an uninsured driver or in the case of a hit and run accident, a claim can still be made through the Motor Insurers’ Bureau.

Only if you as a pedestrian were hit and injured by a motor vehicle due to being careless of your safety and neglecting to take basic precautions, as laid out in the Green Cross Code, and the motor vehicle driver had no opportunity to avoid you, could a claim not be made. Strangely enough, even if you were actually negligent of your road safety as a pedestrian but were hit by a car driver who could have avoided you without endangering themselves, the driver can usually be held to be largely to blame for the accident and a claim might be able to be made.

Make no mistake about, the complexities surrounding making a pedestrian accident claim can be bewildering, from the gathering of evidence at the scene, including making sketches and plans, taking photographs and dealing with witnesses through to presenting what can sometime be the crucial but complex medical reports; it is no task for the inexperienced or unwary, especially bearing in mind that such claims might be stoutly defended by insurance companies or the lawyers of drivers who are unwilling to see their good reputations and a great deal of money disappear without a fight. Although there is nothing to stop the claimant doing all of work for themselves, it can be onerous and from the point of gathering the necessary information to adequately negotiate the claim, potentially more than a little hit and miss. Of course, this all pre-supposes that the claimant’s injuries were slight enough to allow them to independently pursue their own claim. Alas, this is often the not the situation in circumstance where the accident resulted in severe and incapacitating injuries.

Our personal injury solicitors specialise in pedestrian compensation claims. They know what to do.
